This Terms of Use Agreement ("AGREEMENT") is an agreement between you and ServerTell Networks®, which grants you 1) internal use to support, troubleshooting, and the knowledge base, 2) use of services such as MySpeed, RSS Syndicated Directory, Search engines, and all other services available to you via this website.

By using this website, you are deemed to have accepted the ServerTell Networks® Terms of Use Agreement. If you do not agree to the terms of this agreement, you are not authorized to use this site, or services included within this site.

COLLECTION OF PERSONAL INFORMATION --

By using this website, you consent to the collection of personal information and data to be gathered, if any, collected information is backed and protected by our Privacy Policy.

COPYRIGHTED MATERIAL INFRINGEMENT --

This website is heavily protected under the OCILLA (Online Copyright Infringement Liability Limitation Act) Section 512 to the Copyright Law / Title 17 of the United States Code (Public Law No. 105 304, 112 Stat. 2860, 2877). A portion of the Digital Millennium Copyright Act known as DMCA 512 and also the DMCA takedown provisions.

All services, photographs, animations, video, audio, text, public released code, and "applets" are owned by ServerTell Networks®, and are not allowed to be duplicated, deformed, stolen, re-worded, and or used for your own personal use in any way, shape, or form.  Performing any of these restricted actions is strictly against and a violation of this Terms of Use Agreement.

ILLEGAL SERVICE MISUSE --

By using the ServerTell Networks website, you agree that you will not:

• Falsify requested information.
• Use provided communicational support information for advertising purposes ( Personal or Commercial ).
• Abuse the legal privacy rights of others.

SECURITY --

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

TRADEMARKS --

ServerTell Networks®, ServerTell MySpeed®, ServerTell Search®, ServerTell Site Search,® ServerTell News Articles®, ServerTell Online Interactive Tutorial®, ServerTell RSS Sync, mystream!®, ServerTell Mobile®, and all other services, photographs, animations, video, audio, text, public released code, and "applets" are registered trademarks of ServerTell Networks®.  Personal use without permission is strictly prohibited.

6.

TERMS USE --

ServerTell Networks® reserves the right at any undisclosed time to revise, change, or update this Terms of Use Agreement without prior notice.

7.

BACKUP --

You are responsible for taking your own backups of files, SQL databases and other data using a method within the terms of your account with ServerTell Networks®. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients responsibility to maintain local copies of their content.

8.

NETWORK PERFORMANCE --

Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner results in impaired network performance is prohibited by this policy and may result in termination of your account.

9.

AFFILIATE CONTENT LIABILITY --

On occasion, certain links will take you out of the ServerTell Networks website.  We are not responsible for content on affiliate websites.
